TERMS AND CONDITIONS

JustPrenups

TERMS AND CONDITIONS

Effective Date: October 6, 2026

1. NO ATTORNEY-CLIENT RELATIONSHIP IMPORTANT:

Merely visiting this website, submitting an inquiry, requesting information, scheduling or participating in a consultation, communicating with an attorney, reviewing a proposed prenuptial agreement, participating in mediation, or receiving information from JustPrenups does not create an attorney-client relationship.

An attorney-client relationship is created only when an attorney expressly agrees in writing to represent you, the applicable engagement arrangements have been completed, and the required fee or other agreed payment has been received. Unless and until those requirements have been satisfied, you are not a client of JustPrenups, Just Mediated Prenups, Inc., Chantale L. Suttle, Esq., or any other attorney associated with JustPrenups.

You may not represent to any person or entity that you are represented by JustPrenups or by any attorney associated with JustPrenups unless that attorney has expressly agreed in writing to represent you.

2. FREE CONSULTATIONS DO NOT CREATE REPRESENTATION

A free initial consultation is provided for the limited purpose of discussing whether JustPrenups may be able to provide services to you and, where applicable, explaining the nature of the Services.

A free consultation does not create an attorney-client relationship.

This is particularly important where one fiancé has retained JustPrenups to prepare or facilitate a prenuptial agreement and the other fiancé seeks a consultation concerning that agreement.

The fact that you speak with an attorney, provide information, receive a proposed agreement, ask questions, discuss revisions, participate in mediation, receive information concerning the agreement, or have your name or an attorney's name appear anywhere in a proposed agreement does not, by itself, establish an attorney-client relationship.

3. ONE FIANCÉ'S ATTORNEY DOES NOT REPRESENT THE OTHER FIANCÉ

When JustPrenups is engaged by one person in connection with a prenuptial agreement, the other fiancé is not automatically a client of JustPrenups or of the attorney representing the first fiancé.

If the other fiancé desires independent legal advice or representation, that person is responsible for separately retaining an attorney of their choice.

Payment by one fiancé does not create an attorney-client relationship with the other fiancé.

Likewise, the fact that an attorney has communicated with both fiancés concerning a mediated or jointly facilitated process does not, standing alone, establish that the attorney represents both parties individually. The scope of any representation or mediation relationship will be determined by the applicable written agreement.

4. PROHIBITION AGAINST UNAUTHORIZED USE OF AN ATTORNEY'S NAME

You may not add, insert, type, copy, paste, identify, designate, or otherwise cause the name of JustPrenups, Just Mediated Prenups, Inc., Chantale L. Suttle, Esq., or any other attorney associated with JustPrenups to appear in a prenuptial agreement, postnuptial agreement, engagement agreement, disclosure, signature page, attorney-certification provision, notice, correspondence, court filing, or other document as your attorney or as counsel for you unless that attorney has expressly authorized that designation in writing.

This prohibition applies regardless of who places the language in the document, including you, your fiancé(e), your fiancé(e)'s attorney, another attorney, a mediator, a document preparer, or any other third party.

An attorney's name appearing in a document does not establish an attorney-client relationship.

An attorney-client relationship cannot be created unilaterally by a person who is not a client.

5. PROHIBITION AGAINST FALSE REPRESENTATIONS OF LEGAL REPRESENTATION

You agree that you will not falsely state, represent, imply, or cause another person to believe that JustPrenups, Just Mediated Prenups, Inc., Chantale L. Suttle, Esq., or any other attorney associated with JustPrenups represents you when no such representation has been expressly undertaken.

This includes, without limitation:

1. stating orally or in writing that an attorney represents you;

2. identifying an attorney as your attorney on a prenuptial agreement;

3. listing an attorney as your counsel on a signature page;

4. inserting an attorney's name into an independent-counsel or attorney-review provision;

5. telling your fiancé(e), your fiancé(e)'s attorney, another attorney, a mediator, a court, or any other person that an attorney represents you;

6. forwarding or using a document containing an unauthorized designation of representation while knowing that the designation is inaccurate; or

7. creating or participating in any other communication, document, electronic record, or representation that falsely suggests that an attorney-client relationship exists.

If you discover that an attorney's name has been improperly or inaccurately inserted into a document, you must promptly notify the attorney and take reasonable steps to correct the inaccurate representation.

6. LIQUIDATED DAMAGES FOR UNAUTHORIZED REPRESENTATION

You acknowledge that an unauthorized representation that an attorney represents you can cause substantial harm that may be difficult or impossible to determine precisely when the unauthorized representation occurs.

Such harm may include, without limitation: professional and reputational injury; investigation and record-preservation expenses; time and legal expense required to establish that no attorney-client relationship existed; costs of correcting inaccurate documents or communications; disruption of an attorney's professional obligations; potential conflicts of interest; the need to respond to courts, attorneys, governmental agencies, clients, or other third parties; and litigation or other legal proceedings arising from the unauthorized representation.

Accordingly, you agree that $5,000 is a reasonable estimate of the damages likely to be sustained from each separate unauthorized act of representing or causing others to believe that JustPrenups or an attorney associated with JustPrenups represents you.

The parties intend this amount to constitute liquidated damages and not a penalty.

The parties acknowledge that actual damages may be difficult to ascertain with reasonable certainty and that the $5,000 amount represents a reasonable effort to establish damages in advance.

Multiple Appearances of an Attorney's Name

The liquidated damages amount is not multiplied merely because the same unauthorized representation appears more than once within a single document.

For example, if an attorney's name is improperly inserted five times into one prenuptial agreement, that does not automatically create five separate $5,000 claims. A single document containing multiple substantially identical references to the same unauthorized representation will ordinarily constitute one unauthorized act for purposes of this liquidated-damages provision.

A separate document, court filing, communication, or substantially separate act that independently represents or implies that the attorney represents you may constitute a separate unauthorized act.

7. OTHER REMEDIES RESERVED

The liquidated damages described above are intended to address damages that may be difficult to quantify in advance. They do not prevent JustPrenups, Just Mediated Prenups, Inc., or an affected attorney from seeking any other remedy that is permitted by law, including injunctive or declaratory relief, correction or withdrawal of a false representation, attorneys' fees and costs where authorized by law, sanctions where available, and other equitable or legal remedies.

Nothing in these Terms limits any remedy that cannot lawfully be waived or limited.

8. PROSPECTIVE CLIENTS

A person who consults with an attorney concerning the possibility of forming an attorney-client relationship may be a prospective client under applicable professional-conduct rules. Being a prospective client is not the same as being a client.

Nothing in these Terms is intended to waive or diminish any duty that JustPrenups, Just Mediated Prenups, Inc., or an attorney may have to a prospective client under applicable law or the Rules Regulating The Florida Bar.

9. WEBSITE INFORMATION IS NOT LEGAL ADVICE

Information on this website is provided for general educational and informational purposes. Legal principles vary according to the facts of each matter, jurisdiction, timing, applicable law, and changes in the law. Website information is not a substitute for individualized legal advice and does not guarantee any legal outcome.

10. NO GUARANTEE OF ENFORCEABILITY

No attorney or service provider can guarantee that a particular prenuptial or postnuptial agreement will ultimately be enforced by a court. Enforceability may depend on disclosure, voluntariness, timing, circumstances surrounding execution, applicable law, subsequent events, and the specific language of the agreement.

11. INDEPENDENT LEGAL COUNSEL

When appropriate, a party to a prenuptial agreement may be advised to obtain independent legal counsel. Independent legal counsel means counsel who is actually retained to represent that party and who owes that party the duties of an attorney-client relationship. Simply meeting with an attorney, receiving comments, or having an attorney's name appear in a document does not necessarily establish representation.

12. ACCURACY OF INFORMATION PROVIDED

You agree that information you provide to JustPrenups, including information concerning yourself, your fiancé(e), assets, liabilities, income, employment, prior marriages, children, and other matters relevant to a prenuptial agreement, will be truthful and complete to the best of your knowledge. You are responsible for promptly correcting information that you later learn is inaccurate or incomplete.

13. DOCUMENTS AND ELECTRONIC COMMUNICATIONS

Documents provided through the website or in connection with the Services may be drafts, educational materials, forms, questionnaires, proposed agreements, or other work product. You may not alter, modify, reproduce, distribute, or use a document in a manner that falsely represents who prepared it, who represents a party, the scope of representation, the existence of attorney review, or the authorization of an attorney.

14. FEES AND PAYMENT

Fees for legal services are governed by the applicable engagement agreement and applicable law. Payment for one service does not automatically entitle a person to unrelated legal services. Payment by one fiancé does not automatically establish an attorney-client relationship with the other fiancé. Any person seeking independent legal representation must separately establish an attorney-client relationship with the attorney they retain.

15. CANCELLATION, TERMINATION, AND DECLINING REPRESENTATION

JustPrenups and its attorneys reserve the right to decline representation or discontinue services to the extent permitted by applicable law and professional-conduct rules. Nothing on this website obligates JustPrenups or any attorney to accept a person as a client. If representation has commenced, termination will be governed by applicable law, the engagement agreement, and the Rules Regulating The Florida Bar.

16. INTELLECTUAL PROPERTY

Unless otherwise indicated, the content of this website, including text, graphics, logos, photographs, documents, forms, articles, designs, and other materials, is owned by or licensed to JustPrenups or its affiliates and is protected by applicable intellectual-property laws. You may not reproduce, publish, distribute, modify, sell, or commercially exploit website content without prior written permission.

17. THIRD-PARTY WEBSITES AND SERVICES

This website may contain links to third-party websites or services. JustPrenups is not responsible for the content, privacy practices, security, availability, or accuracy of third-party websites or services. Your use of third-party websites is subject to their terms and policies.

18. PRIVACY AND WEBSITE COMMUNICATIONS

Information submitted through this website may be subject to our Privacy Policy. Website communications should not be assumed to be confidential attorney-client communications merely because the website is operated by or associated with attorneys. Do not submit highly sensitive or confidential information through a website form unless specifically instructed to do so.

19. ELECTRONIC COMMUNICATIONS

By using the website, you consent to receive electronic communications concerning inquiries, appointments, services, documents, payments, and other matters relating to your use of the Services, subject to applicable law. Electronic communications may not always be secure.

20. NO UNAUTHORIZED RELIANCE

You may not rely upon a communication from JustPrenups or an attorney as individualized legal advice unless that attorney has expressly agreed to provide such advice within an established attorney-client relationship. A general answer, educational explanation, website article, email, telephone conversation, meeting, or other communication should not be construed as establishing representation unless the attorney expressly agrees to undertake it.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, JustPrenups and Just Mediated Prenups, Inc. disclaim liability for losses arising from reliance upon general information provided through the website where no attorney-client relationship has been established. Nothing in these Terms is intended to waive any liability that cannot lawfully be waived or limited, or to limit duties owed by an attorney to an actual client under applicable law or the Rules Regulating The Florida Bar.

22. INDEMNIFICATION FOR FALSE REPRESENTATIONS

To the extent permitted by applicable law, a person who knowingly or intentionally makes a false representation that JustPrenups or an attorney associated with JustPrenups represents that person, or who knowingly or intentionally causes such a representation to appear in a legal document without authorization, agrees to indemnify and hold harmless JustPrenups, Just Mediated Prenups, Inc., and the affected attorney from losses, damages, claims, costs, and expenses directly resulting from that unauthorized representation, except to the extent caused by the indemnitee's own conduct for which indemnification is prohibited by law.

23. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law or applicable professional-conduct rules require otherwise.

24. VENUE AND JURISDICTION

To the extent permitted by applicable law, disputes arising from these Terms or use of the Services shall be brought in a court of competent jurisdiction in the State of Florida. Nothing in this provision prevents JustPrenups or an attorney from seeking emergency equitable relief in any court having jurisdiction where necessary to prevent unauthorized use of an attorney's name, confidential information, intellectual property, or other legally protected interest.

25. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

26. NO WAIVER

A failure by JustPrenups to enforce any provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision in the future.

27. CHANGES TO THESE TERMS

JustPrenups may modify these Terms from time to time. Updated Terms will become effective when posted on the website unless otherwise stated. Continued use of the website following posting of revised Terms constitutes acceptance of the revised Terms.

28. ENTIRE AGREEMENT

These Terms constitute the general terms governing use of the website. If you become a client, the written engagement agreement governing your legal representation will control the attorney-client relationship and scope of legal services to the extent of any conflict between that engagement agreement and these website Terms.

IMPORTANT NOTICE REGARDING ATTORNEY REPRESENTATION

PLEASE READ THIS CAREFULLY.

No one may make you a client of JustPrenups or of an attorney associated with JustPrenups by simply putting the attorney's name into a prenuptial agreement.

If you have not been expressly accepted as a client and have not completed the required engagement and payment arrangements, you must not state or imply that JustPrenups or any attorney associated with JustPrenups represents you.

You may not add an attorney's name to a prenuptial agreement or other legal document as your attorney without that attorney's prior written authorization.

If an attorney's name is placed in a document without authorization, JustPrenups and the affected attorney expressly reserve all rights and remedies available under applicable law, including, where legally available, damages, liquidated damages, injunctive relief, attorneys' fees and costs, sanctions, and any other appropriate remedy.

These website-use provisions do not supersede any separate written attorney engagement agreement or create an attorney-client relationship.

The Website is intended for lawful use in obtaining general information about JustPrenups and its services. You agree to comply with laws applicable to your use of the Website.

30. EDUCATIONAL PURPOSES ONLY; LEGAL DISCLAIMER

ALL ARTICLES, BLOG POSTS, GUIDES, FREQUENTLY ASKED QUESTIONS, EXAMPLES, VIDEOS, DOWNLOADS, AND OTHER CONTENT PUBLISHED ON THE WEBSITE ARE PROVIDED FOR GENERAL EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. THEY DO NOT CONSTITUTE LEGAL ADVICE, AN ATTORNEY’S OPINION CONCERNING YOUR INDIVIDUAL MATTER, OR A RECOMMENDATION THAT YOU TAKE OR REFRAIN FROM ANY PARTICULAR ACTION.

Website content may discuss general legal concepts but cannot account for your particular facts, objectives, applicable jurisdiction, deadlines, or subsequent changes in the law. You should not act or decline to act on the basis of Website content without first seeking individualized advice from an attorney separately retained to represent your interests. No article, sample language, illustrative scenario, educational material, response to a general question, or other Website content guarantees that an agreement will be valid, enforceable, or appropriate for any particular person. This section supplements, and does not replace, Sections 1, 9, 10, and 20 above.

31. PROHIBITED WEBSITE ACTIVITIES

You may not use the Website to engage in unlawful, fraudulent, misleading, harassing, or infringing conduct; misrepresent your identity or relationship with JustPrenups; attempt to gain unauthorized access to any account, system, or nonpublic information; interfere with Website operation or security; introduce malicious code; or use automated tools to scrape, harvest, overload, or extract Website content or personal information without prior written authorization. You may not use Website content or materials in a way that suggests endorsement, legal representation, attorney review, or authorization that has not actually been provided. Sections 4 through 7 and 16 above remain applicable.

32. CONTENT ACCURACY AND CURRENCY

Although JustPrenups may update Website content periodically, it makes no representation that general Website materials are complete, current, error-free, or applicable to your circumstances. References to laws, court decisions, procedures, fees, or services may become outdated. Website content may be corrected, changed, or removed without advance notice.

Descriptions of services are general and do not constitute an offer or obligation to undertake representation or provide any specific legal service.

33. WEBSITE AVAILABILITY AND TECHNICAL DISCLAIMERS

The Website and its general informational content are made available on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, JustPrenups does not warrant uninterrupted access, absence of technical errors, or freedom from viruses or other harmful components. Access may be suspended or restricted for maintenance, security, or operational reasons.

You are responsible for using appropriate security measures when accessing the Website. Nothing in this section limits duties or responsibilities that cannot lawfully be disclaimed, including those owed to actual or prospective clients under applicable law and the Rules Regulating The Florida Bar.

34. RELATIONSHIP TO EXISTING TERMS

These additional website-use provisions are incorporated into the Terms and Conditions effective October 6, 2026. They supplement the existing provisions, which remain unchanged. In the event of a conflict, the more specific provision governing attorney-client relationships, prospective clients, professional duties, or a separate written engagement agreement shall control to the extent required by applicable law.
